Illinois house passes bill to change how municipalities close fire departments
BND.com recently published an article discussing a new bill introduced in the Illinois House that would significantly change the process for closing a fire department at the municipal level. The proposed legislation, sponsored by Rep. Jay Hoffman, has sparked considerable debate and is now heading to the Senate after passing in the House with a strong vote of 93 to 20.
The bill, known as HB4418, aims to make it more difficult for cities and villages to shut down their fire departments without public input. Specifically, it would require any municipality wishing to close a fire department to hold a referendum first. This means that voters, rather than city officials alone, would have the final say on such a major decision.
Rep. Hoffman, a Democrat from Swansea, emphasized that the bill is designed to ensure transparency and accountability. "If a fire district is going to be dissolved in a municipality or a village, the voters will have a say," he told his colleagues during the debate. He also clarified that the bill does not prevent cities from working with other municipalities through intergovernmental agreements, but simply requires voter approval before dissolving a fire department.
The legislation faced opposition from the Illinois Municipal League and other city groups, who argue that it takes control away from local leaders and places it in the hands of voters. However, Hoffman defended the bill, stating that it was initiated by the Associate Fire Fighters of Illinois, a labor group representing firefighters. "It simply says that if you want to dissolve a fire department, voters get to decide," he said.
Pat Devaney, president of the firefighter association, supported the bill, saying it's not about making it harder to lay off firefighters, but about giving voters a voice in critical emergency services decisions. "We believe a decision with such serious consequences should be put before the voters in a referendum," he added. He also stressed that requiring elected leaders to seek voter approval is a reasonable step.
In addition to this bill, the House recently passed another measure, HB5485, which would allow arbitrators to consider minimum staffing requirements for fire departments during labor negotiations between unions and city officials.
Here’s how some metro-east representatives voted on Hoffman’s bill:
- Rep. Dan Beiser (D-Alton): Yes
- Rep. John Cavaletto (R-Salem): Yes
- Rep. Jerry Costello II (D-Smithton): Yes
- Rep. Jay Hoffman (D-Swansea): Yes
- Rep. Eddie Lee Jackson (D-East St. Louis): Yes
- Rep. Dwight Kay (R-Glen Carbon): No
- Rep. Charlie Meier (R-Okawville): Yes
With the growing concern over public safety and the role of local government, this bill highlights the ongoing tension between municipal autonomy and democratic participation. As the Senate considers the proposal, it remains to be seen whether the measure will gain similar support or face further challenges.
